The Paper as Set

The questions in this volume are the questions asked at the Nov 2011 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)What is Therapeutic Purpose?[2]

Answer

"Therapeutic purposes" means treatment of disease or improvement of health. "'therapeutic purposes' means systematic treatment of any disease or the measures to improve health according to any particular method or modality" (section 2(o), Transplantation of Human Organs and Tissues Act, 1994).

Its two parts.

  1. Treatment of disease. For example, a kidney transplant for a patient whose kidneys have failed.
  2. Measures to improve health. For example, a corneal graft that restores sight. The words "any particular method or modality" cover every accepted way of treatment.

Why the definition matters. It is the only purpose for which the Act allows organs to be taken.

  1. A donor may authorise removal "for therapeutic purposes" only (section 3(1), (2)).
  2. A hospital is registered for removal, storage or transplantation "for therapeutic purposes" (section 14(1)).
munotes.in 2
  1. No donor or other person may authorise removal "for any purpose other than therapeutic purposes" (section 11).
  2. Removal for any other purpose, such as sale, is an offence. Commercial dealing in organs is punishable under section 19.

The aim behind it. Limiting removal to therapeutic purposes keeps transplantation a matter of treatment, not trade. In Kuldeep Singh v. State of Tamil Nadu, (2005) 11 SCC 122, the Supreme Court explained that the Act's foundation was "the shocking exploitation of abject poverty of many donors".
