munotes.in is an independent study resource for students of the University of Mumbai. It is not affiliated with the University of Mumbai, and is not endorsed by it.

The University does not publish an official answer key for this paper. The answers in this volume are model answers, written to show how a full-mark answer is built. They are a study aid, not an authority on what an examiner marked.

The question paper reproduced here is the paper as set by the University of Mumbai at the May 2026 - 75/25 examination.

The law under these papers has moved. The Indian Penal Code, the Code of Criminal Procedure and the Evidence Act were replaced by the BNS, BNSS and BSA on 1 July 2024; adultery (section 497) was struck down on 27 September 2018 and is not in the BNS. The Maternity Benefit Act, the Factories Act and the Equal Remuneration Act were repealed on 21 November 2025 by the Code on Social Security, the OSH Code and the Code on Wages. The Child Marriage Restraint Act, 1929 gave way to the 2006 Act on 1 November 2007, and the Juvenile Justice Act, 2000 to the 2015 Act on 15 January 2016. Each answer gives the law the paper asked about and the law that applies now.

The Paper as Set

The questions in this volume are the questions asked at the May 2026 - 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  21 questions answered

Instructions printed on the paper

  • N.B: 1. All questions are compulsory. 2. Figures to the right indicate full marks.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

Q.1

Q.1: Answer the following in not more than two sentences, any six

12 Marks - 2 marks each

(1)What is meant by dowry?[2]

Answer

Dowry is defined in section 2 of the Dowry Prohibition Act, 1961. It means "any property or valuable security given or agreed to be given either directly or indirectly" in connection with a marriage.

The elements of the definition.

  1. It is property or a valuable security. A valuable security is a document that creates or transfers a legal right (section 30 of the Indian Penal Code).
  2. It is given, or only agreed to be given, directly or indirectly.
  3. It passes from one party to the other. Or it passes from the parents of either party, or any other person, to either party or to anyone else.
  4. It is given "at or before or any time after the marriage".
  5. It is given "in connection with the marriage of the said parties".

What is excluded. Dower or mahr is not dowry, for persons to whom Muslim Personal Law (Shariat) applies. Presents given at the wedding without any demand, and entered in a list, are also not punished (section 3(2)).

munotes.in 2

How the courts read it. In Rajinder Singh v. State of Punjab, decided on 26 February 2015, the Supreme Court held that "in connection with" means "relating to". So a demand for money made years after the wedding can still be a demand for dowry.

Conclusion. Dowry is any property demanded or given because of a marriage, at any time, except mahr. Giving, taking and demanding it are offences under sections 3 and 4 of the Act.
