munotes.in is an independent study resource for students of the University of Mumbai. It is not affiliated with the University of Mumbai, and is not endorsed by it.

The University does not publish an official answer key for this paper. The answers in this volume are model answers, written to show how a full-mark answer is built. They are a study aid, not an authority on what an examiner marked.

The question paper reproduced here is the paper as set by the University of Mumbai at the May 2025 - 60/40 examination.

The law under these papers has moved. The Indian Penal Code, the Code of Criminal Procedure and the Evidence Act were replaced by the BNS, BNSS and BSA on 1 July 2024; adultery (section 497) was struck down on 27 September 2018 and is not in the BNS. The Maternity Benefit Act, the Factories Act and the Equal Remuneration Act were repealed on 21 November 2025 by the Code on Social Security, the OSH Code and the Code on Wages. The Child Marriage Restraint Act, 1929 gave way to the 2006 Act on 1 November 2007, and the Juvenile Justice Act, 2000 to the 2015 Act on 15 January 2016. Each answer gives the law the paper asked about and the law that applies now.

The Paper as Set

The questions in this volume are the questions asked at the May 2025 - 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2 hours  ·  Total marks 60  ·  22 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(1)What is option of puberty as per the Muslim law?[2]

Answer

The option of puberty (khyar-ul-bulugh) is the right of a person married as a child by a guardian to reject the marriage on growing up. In Muslim law it protects a girl married off before she could consent.

The statutory rule. Section 2(vii) of the Dissolution of Muslim Marriages Act, 1939 lets a wife obtain a decree of dissolution if:

  1. she was given in marriage by her father or other guardian before fifteen;
  2. she repudiated the marriage before eighteen; and
  3. the marriage has not been consummated.

What the 1939 Act changed. Under classical Hanafi law, a marriage arranged by the father or paternal grandfather could not be repudiated unless they had acted fraudulently or negligently. The Act removed that limit.

The courts. In Khatiza Tul Qubra v. Iqbal Mohd., decided on 27 January 2009, a girl married by her father as a child repudiated the marriage at fifteen. The Rajasthan High Court held that she did not need a separate decree. Proof of repudiation in the husband's own suit was enough.

Other laws. A Hindu wife married before fifteen may seek divorce if she repudiated the marriage between fifteen and eighteen (Hindu Marriage Act, 1955, section 13(2)(iv)). Any child marriage is also voidable at the child's option until two years after majority (Prohibition of Child Marriage Act, 2006, section 3).

Conclusion. The option of puberty lets a girl married before fifteen reject the marriage before eighteen, if it was not consummated.
