munotes.in is an independent study resource for students of the University of Mumbai. It is not affiliated with the University of Mumbai, and is not endorsed by it.

The University does not publish an official answer key for this paper. The answers in this volume are model answers, written to show how a full-mark answer is built. They are a study aid, not an authority on what an examiner marked.

The question paper reproduced here is the paper as set by the University of Mumbai at the May 2022 examination.

The law under these papers has moved. The Indian Penal Code, the Code of Criminal Procedure and the Evidence Act were replaced by the BNS, BNSS and BSA on 1 July 2024; adultery (section 497) was struck down on 27 September 2018 and is not in the BNS. The Maternity Benefit Act, the Factories Act and the Equal Remuneration Act were repealed on 21 November 2025 by the Code on Social Security, the OSH Code and the Code on Wages. The Child Marriage Restraint Act, 1929 gave way to the 2006 Act on 1 November 2007, and the Juvenile Justice Act, 2000 to the 2015 Act on 15 January 2016. Each answer gives the law the paper asked about and the law that applies now.

The Paper as Set

The questions in this volume are the questions asked at the May 2022 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1Define a type of Mehar which is to be paid later on. (a) Meher-e-misl (b) Marzal/Mrjal (c) Muwwazal (d) Kharch-e-pandan

Answer

The answer is (c), Muwwazal: deferred dower (mu'wajjal).

The rule. Dower (mahr) is usually split into two parts. The prompt part "is payable on demand". The deferred part "is payable on dissolution of marriage by death or divorce" (Mulla, Principles of Mahomedan Law, section 221(1)). So the dower "paid later on" is the deferred dower.

The Arabic name. In Sheik Muhammad Rowther v. Ayeesha Beevi, (1937) 2 MLJ 779, the Madras High Court translated a classical text. It speaks of dower "with a condition of immediate payment (that is, Mooujjil)" or "with a condition of its being deferred (Movajjal)". Option (c), "Muwwazal", is the paper's spelling of this second word.

Why the others are wrong.

  1. (a) Meher-e-misl (mahr-i-misl) is proper or customary dower. It is the amount due when no dower was fixed, measured by the dower of the women of her father's family (section 220). It tells us how the amount is fixed, not when it is paid.
munotes.in 2
  1. (b) Marzal is not one of the kinds of dower in Mulla's classification. If it is meant for mu'ajjal, that is prompt dower, payable at once on demand.
  2. (d) Kharch-e-pandan (kharch-i-pandan) is not dower at all. It is a personal allowance for the wife's "betel-leaf expenses", agreed between the two families at the marriage (Mulla, section 226A).
