munotes.in is an independent study resource for students of the University of Mumbai. It is not affiliated with the University of Mumbai, and is not endorsed by it.

The University does not publish an official answer key for this paper. The answers in this volume are model answers, written to show how a full-mark answer is built. They are a study aid, not an authority on what an examiner marked.

The question paper reproduced here is the paper as set by the University of Mumbai at the May 2023 - 60/40 examination.

The law under these papers has moved. The Indian Penal Code, the Code of Criminal Procedure and the Evidence Act were replaced by the BNS, BNSS and BSA on 1 July 2024; adultery (section 497) was struck down on 27 September 2018 and is not in the BNS. The Maternity Benefit Act, the Factories Act and the Equal Remuneration Act were repealed on 21 November 2025 by the Code on Social Security, the OSH Code and the Code on Wages. The Child Marriage Restraint Act, 1929 gave way to the 2006 Act on 1 November 2007, and the Juvenile Justice Act, 2000 to the 2015 Act on 15 January 2016. Each answer gives the law the paper asked about and the law that applies now.

The Paper as Set

The questions in this volume are the questions asked at the May 2023 - 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2 hours  ·  Total marks 60  ·  22 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(1)What is a brothel under the Immoral Traffic (Prevention) Act?[2]

Answer

The definition. Section 2(a) of the Immoral Traffic (Prevention) Act, 1956 defines a brothel. It "includes any house, room, conveyance or place or any portion of any house, room, conveyance or place, which is used for purposes of sexual exploitation or abuse for the gain of another person or for the mutual gain of two or more prostitutes".

Its elements.

  1. A place of any kind. A house, a room, a vehicle or any other place, or a part of one. "Conveyance" (a vehicle) was added by Act 46 of 1978.
  2. Used for sexual exploitation or abuse. "Prostitution" means "the sexual exploitation or abuse of persons for commercial purpose" (section 2(f)).
  3. For gain. The gain must be of another person, such as a keeper or pimp, or the shared gain of two or more prostitutes. So, on the words of the definition, one woman alone in her own room for her own gain does not make it a brothel.

Why it matters. Section 3 punishes anyone who keeps or manages a brothel, with rigorous imprisonment of one to three years on a first conviction. It also punishes a tenant or landlord who knowingly allows premises to be used as one. Section 6 punishes detaining a person in a brothel. Under section 18, a magistrate may evict the occupier of a brothel near a public place. It must be within two hundred metres of, for example, a school or a temple.

Conclusion. A brothel is any place used for sexual exploitation for someone else's gain or the shared gain of two or more prostitutes.
