munotes.in is an independent study resource for students of the University of Mumbai. It is not affiliated with the University of Mumbai, and is not endorsed by it.

The University does not publish an official answer key for this paper. The answers in this volume are model answers, written to show how a full-mark answer is built. They are a study aid, not an authority on what an examiner marked.

The question paper reproduced here is the paper as set by the University of Mumbai at the Nov 2022 - 60/40 examination.

The law under these papers has moved. The Indian Penal Code, the Code of Criminal Procedure and the Evidence Act were replaced by the BNS, BNSS and BSA on 1 July 2024; adultery (section 497) was struck down on 27 September 2018 and is not in the BNS. The Maternity Benefit Act, the Factories Act and the Equal Remuneration Act were repealed on 21 November 2025 by the Code on Social Security, the OSH Code and the Code on Wages. The Child Marriage Restraint Act, 1929 gave way to the 2006 Act on 1 November 2007, and the Juvenile Justice Act, 2000 to the 2015 Act on 15 January 2016. Each answer gives the law the paper asked about and the law that applies now.

The Paper as Set

The questions in this volume are the questions asked at the Nov 2022 - 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2 hours  ·  Total marks 60  ·  22 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)What is Domestic Violence?[2]

Answer

The definition. Domestic violence is defined in section 3 of the Protection of Women from Domestic Violence Act, 2005. Any act, omission or conduct of the respondent is domestic violence if it:

  1. "harms or injures or endangers the health, safety, life, limb or well-being, whether mental or physical, of the aggrieved person", including physical, sexual, verbal and emotional, and economic abuse;
  2. harasses her to coerce her or her relatives "to meet any unlawful demand for any dowry or other property";
  3. threatens her or her relatives with such conduct; or
  4. otherwise injures or harms her, physically or mentally.

The four kinds of abuse (Explanation I).

  1. Physical: acts causing bodily pain or harm, including assault and criminal force.
  2. Sexual: conduct of a sexual nature that "abuses, humiliates, degrades or otherwise violates the dignity of woman".
munotes.in 2
  1. Verbal and emotional: insults, ridicule and name-calling, especially about "not having a child or a male child", and repeated threats.
  2. Economic: depriving her of money or resources she is entitled to, or disposing of her property or stridhan. It includes cutting off her access to the shared household.

Who is protected. A woman in a "domestic relationship" with the respondent, living or having lived in a shared household. She may be a wife, a partner in a relationship in the nature of marriage, a mother, sister or daughter.

Case. In Hiral P. Harsora v. Kusum Narottamdas Harsora, AIR 2016 SC 4774, the Supreme Court struck down the words "adult male" in section 2(q). So domestic violence by a woman relative is also covered.

Conclusion. Domestic violence means physical, sexual, verbal, emotional or economic abuse of a woman, or dowry harassment, by a person in a domestic relationship with her.
