The Paper as Set

The questions in this volume are the questions asked at the Apr 2025 - 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2 hours  ·  Total marks 60  ·  22 questions answered

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(1)Who is a Mediator?[2]

Answer

A mediator is the neutral third person who helps the parties to a dispute reach their own settlement. He has no power to decide the dispute or to impose terms.

Statutory definition. Section 3(i) of the Mediation Act, 2023 is in force. It says a "mediator" means a person appointed by the parties or by a mediation service provider to undertake mediation. It includes a person registered as a mediator with the Mediation Council of India. Section 3(h) explains that in mediation the mediator "does not have the authority to impose a settlement upon the parties". The Council itself has not yet been established (Lok Sabha answer of 13 February 2026), and the Act's procedural sections are not yet in force.

What a mediator does.

  1. Helps the parties talk to each other, often meeting them separately.
  2. Helps them identify their real interests and explore options.
  3. Keeps everything confidential.
  4. Records only the result. If the talks fail, he reports only that they failed.

Moti Ram (D) v. Ashok Kumar, (2011) 1 SCC 466. The Supreme Court had sent a landlord and tenant to a mediation centre. The mediator's report set out each side's offers. The Court said "mediation proceedings are totally confidential proceedings". A mediator should report only that "Mediation has been unsuccessful", and nothing that was discussed, proposed or done.
