The Paper as Set

The questions in this volume are the questions asked at the 2021-22 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1A.D.R. stands for ______. (a) Automated Discovery Response (b) Alternate Dispute Resolution (c) Exact Dispute Resolution (d) Automated Dispute Resolution

Answer

The answer is (b), Alternate Dispute Resolution.

A.D.R. means settling a dispute by a method other than a trial in court: negotiation, mediation, conciliation, arbitration or the Lok Adalat. Section 89 of the Code of Civil Procedure names four such methods to which a court may refer a case: arbitration, conciliation, judicial settlement including settlement through Lok Adalat, and mediation. "Alternative" and "alternate" are both used for the same idea.

Why the others are wrong. "Automated Discovery Response" and "Automated Dispute Resolution" describe software, not a legal process. "Exact Dispute Resolution" is not a known term.

Afcons Infrastructure Ltd. v. Cherian Varkey Construction Co. (P) Ltd., (2010) 8 SCC 24. The Supreme Court described section 89 as naming one adjudicatory process, arbitration, and four "negotiatory (non adjudicatory)" processes: conciliation, mediation, judicial settlement and Lok Adalat settlement. Together these are what A.D.R. stands for in Indian law.
