The Paper as Set

The questions in this volume are the questions asked at the May 2026 - 60/40 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2 hours  ·  Total marks 60  ·  22 questions answered

Instructions printed on the paper

  • N.B: 1. Answer all questions. 2. The marks are as indicated on the right side of the question. 3. You are expected to answer based on constitutional/legal provisions, case laws and juristic works.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)What do you mean by Analytical Jurisprudence?[2]

Answer

Analytical jurisprudence is the study of law as it is, in a developed legal system. It does not ask how the law came to be or whether it is good. It analyses the basic ideas the law uses, such as right, duty, person, property, possession, ownership and sanction, and fixes their meaning precisely. It is also called the analytical, imperative, positivist or English school.

Its main features.

  1. Law as it is, not as it ought to be. The existence of a law is one question; its merit is another.
  2. Law is made by the State. Law is the command of the sovereign, or a rule made by a competent authority.
  3. Legislation is the typical form of law. Custom and precedent count only when the State adopts them.
  4. Method of analysis. It breaks legal concepts into their elements and arranges them systematically.

Its jurists. Jeremy Bentham was its forerunner and John Austin its founder, through The Province of Jurisprudence Determined (1832). Holland, Salmond and Hohfeld developed it, and Kelsen and H.L.A. Hart gave it modern form.

Its limit. By excluding history, morality and the working of law in society, it cannot explain why law changes or whether a law is just. The historical, natural law and sociological schools grew partly in reaction to it.
