The Paper as Set

The questions in this volume are the questions asked at the May 2019 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

Instructions printed on the paper

  • N.B: Please check whether you have got the right question paper. 1. Answer all questions. 2. Total marks for questions are indicated in the right end.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)What does the term Jurisprudence mean?[2]

Answer

Jurisprudence is the systematic study of law itself: what law is, where it comes from, and what its basic concepts mean. The word comes from the Latin juris, "of law", and prudentia, "knowledge" or "skill". So jurisprudence literally means knowledge of law.

The leading definitions.

  1. Ulpian (Roman jurist): the knowledge of things divine and human, the science of the just and the unjust.
  2. Austin: "the philosophy of positive law".
  3. Holland: "the formal science of positive law".
  4. Salmond: "the science of the first principles of the civil law", meaning the law of the land.
  5. Keeton: the study and systematic arrangement of the general principles of law.
  6. Roscoe Pound: the science of law, which he saw as social engineering.

What it studies. It studies the concepts that every branch of law uses but none defines: right, duty, person, property, possession, ownership and obligation. It also studies the sources of law and the schools of legal thought.

A short definition for the exam. Jurisprudence is the science of law: the theoretical study of the nature of law, its sources, and its fundamental concepts. Holland's image sums up its value: jurisprudence is to law what grammar is to a language.
