The Paper as Set

The questions in this volume are the questions asked at the Oct 2024 - 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  22 questions answered

Instructions printed on the paper

  • N.B: 1. Please check whether you have got the right question paper 2. Answer all questions 3. Total marks are indicated in the right.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)What is meant by Animus Possidendi?[2]

Answer

Animus possidendi means the intention to possess. It is the mental element of possession: the intention to hold a thing for oneself and to exclude others from it. The other element is the corpus possessionis, the physical control of the thing. Possession needs both.

Its features.

  1. It need not be an intention to own. Savigny required an intention to hold as owner. Ihering corrected him. A tenant, a pledgee and a borrower all possess, though none claims to own.
  2. It need not be lawful. A thief has animus possidendi, so he has possession. A second thief who takes the thing from him commits theft against him.
  3. It may be general. A person who possesses a locked box possesses whatever is inside it, even if he does not know what it is.
  4. It may be exercised through another person, such as a servant or an agent.

Why it matters. Corpus without animus is only custody. A servant who holds his master's tools has corpus but no animus, so the master possesses them through him. Animus without corpus is nothing in law: wanting a neighbour's car gives no possession of it.

Example. Ravi locks his car in his garage and goes abroad for a month. He still possesses it. He keeps the power to control it, and he intends to keep others away from it.
