How to use this volume
Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.
Q.1: Write in not more than two sentences
20 Marks - 2 marks each
Answer
A pledge is "the bailment of goods as security for payment of a debt or performance of a promise" (section 172 of the Indian Contract Act, 1872). It has every element of a bailment: delivery of goods for a purpose, and their return. It is called a special kind of bailment because its purpose is always security. That purpose gives the pawnee rights an ordinary bailee does not have.
What makes it special.
Bank of Bihar v. State of Bihar, AIR 1971 SC 1210. Sugar pledged with a bank was seized and sold by the State for a sugar cess due from the pawnor. The Supreme Court held that the pawnee has a "special property" and a lien "which was not of ordinary nature". The State, an unsecured creditor, had to make good to the bank the amount the pledge secured.
So a pledge is a bailment made for security, and the security is what gives it its special rules.
