munotes.in is an independent study resource for students of the University of Mumbai. It is not affiliated with the University of Mumbai, and is not endorsed by it.

The University does not publish an official answer key for this paper. The answers in this volume are model answers, written to show how a full-mark answer is built. They are a study aid, not an authority on what an examiner marked.

The question paper reproduced here is the paper as set by the University of Mumbai at the Oct 2025 - 75/25 examination.

The Paper as Set

The questions in this volume are the questions asked at the Oct 2025 - 75/25 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 2½ hours  ·  Total marks 75  ·  21 questions answered

Instructions printed on the paper

  • N.B: 1. Please check if you have received the correct Question Paper; 2. Answer all Questions as per the instructions given; 3. Do not reveal your identity or put any signs, markings, inscriptions anywhere on your answer sheets; 4. Give relevant case laws / references / illustrations.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

Q.1

Q.1: Answer any six of the following

12 Marks - 2 marks each

munotes.in 1

(a)What are the Core Services rendered by an Information Utility?[2]

Answer

Section 3(9) defines core services as the services rendered by an information utility for:

  1. accepting electronic submission of financial information, in the form and manner specified;
  2. safe and accurate recording of financial information;
  3. authenticating and verifying the financial information submitted by a person; and
  4. providing access to information stored with the utility to persons as specified.

These four services turn scattered loan records into authenticated proof. A financial creditor must submit financial information to a utility (section 215(2)). Since 26 May 2026 an operational creditor must do so before filing under section 9 (section 215(3)). The debtor authenticates the record, and if it stays silent the record is deemed authenticated (section 215(4)).

munotes.in 2

Who may provide them. Only a person registered with the IBBI under section 210 may act as an information utility (section 209). It must be a public company with a net worth of at least fifty crore rupees, whose sole object is to provide core services (regulation 3, IU Regulations). It must give core services to any person who meets the specified terms (section 213).

Why they matter. A record of default with a utility lets the NCLT find default quickly. In Innoventive Industries Ltd. v. ICICI Bank (2018) 1 SCC 407 the Supreme Court held that default may be ascertained from the records of an information utility. Explanation II to section 7(5) (2026) makes such a record, filed by a financial institution, sufficient.
