1.Mention any two acts amounting to Glorification of Sati under The Commission of Sati (Prevention) Act, 1987.[2]

Answer

Section 2(1)(b) of the Commission of Sati (Prevention) Act, 1987 defines glorification of sati. Any two of the four heads answer the question.

First, a ceremony or a procession. The observance of any ceremony, or the taking out of a procession, in connection with the commission of sati.

Second, supporting or propagating the practice. Supporting, justifying or propagating the practice of sati in any manner, which covers a speech, a pamphlet or a post.

The other two heads. The arranging of any function to eulogise the person who has committed sati; and the creation of a trust, the collection of funds, the construction of a temple or other structure, or the carrying on of any form of worship there, with a view to perpetuating the honour or preserving the memory of a person who has committed sati.

The punishment, section 5. Glorification is punishable with imprisonment of not less than one year and up to seven years, and fine of not less than five thousand and up to thirty thousand rupees. Sections 6 and 7 let the Collector or District Magistrate prohibit such ceremonies and seize the funds or the temple property. Under section 9 the offences are tried by Special Courts, and they are cognizable, non-bailable and non-compoundable.

What the section has achieved. After the death of Roop Kanwar at Deorala in 1987, a glorification prosecution was brought over a procession held on the first anniversary. Twenty-five of the accused were acquitted in 2004 and the last eight in October 2024, so the case closed after thirty-seven years with no conviction. The difficulty is evidentiary, not legal: glorification has to be proved against named individuals in a crowd.
