The Paper as Set

The questions in this volume are the questions asked at the Jan 2018 examination, reproduced as the University of Mumbai set them, in the order it set them. Nothing has been reworded, added or left out. Only the answers are ours. See the original question paper.

Duration 3 hours  ·  Total marks 100  ·  25 questions answered

Instructions printed on the paper

  • N.B: Please check whether you have got the right question paper. All questions are compulsory. Cite relevant Case Laws whenever necessary. Figures to right indicate full marks.

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

1.What is meant by an exemplary damages?[2]

Answer

Exemplary damages, also called punitive or vindictive damages, are damages awarded over and above the plaintiff's actual loss. Their aim is to punish the defendant for outrageous conduct and to deter him and others from repeating it. Ordinary damages only compensate the plaintiff.

In Rookes v Barnard [1964] AC 1129 the House of Lords allowed them in only three kinds of case. These are oppressive, arbitrary or unconstitutional action by government servants, conduct calculated to make a profit greater than the compensation payable, and cases where a statute authorises them. In India, in Bhim Singh v State of Jammu and Kashmir (1985) 4 SCC 677, the Supreme Court awarded Rs. 50,000 as exemplary costs to an MLA illegally detained to keep him from the Assembly.
