How to use this volume
Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.
Paper A
Q.P. Code 18210 · , Q.1 Answer in not more than two or three sentences (all 10) 20 Marks
Answer
The indivisibility feature. Sovereignty is one and cannot be split. There can be only one supreme power in a state; two supreme powers over the same people would contradict each other. Willoughby: "Sovereignty, being the supreme will of the State, is indivisible and inalienable." Rousseau mocked those who divide it. They make the sovereign "a fantastic being composed of several connected pieces". He compared them to the conjurers of Japan, who throw a child's limbs into the air and have it fall down "alive and whole".
Is sovereignty divided in a federation? No.
Reason. A federation divides the powers of government, not sovereignty. The constitution gives some subjects to the centre and others to the units. But both levels draw their powers from the same constitution, and the state remains one sovereign whole. Rousseau's phrase fits: the divided powers are "only emanations from it", not parts of sovereignty itself.
India as an example. The Seventh Schedule divides law-making subjects between Parliament and the State Legislatures. Yet in State of West Bengal v. Union of India, AIR 1963 SC 1241, the Supreme Court held that the States do not hold sovereignty of their own. India is a single sovereign state with power shared between two levels of government. If the two levels clash, the Constitution and the courts settle the matter; neither level is the final authority on its own.
