The Paper as Set

How to use this volume

Solve the paper first, under exam conditions and against the clock. Then read the answers here and mark your own. Reading a solution before attempting the question feels productive and teaches very little, because recognising an answer is not the same as being able to write one.

(a)Mention any one provision of GOI Act of 1935?[2]

Answer

One provision of the Government of India Act 1935 was the division of legislative powers into three Lists (section 100 and the Seventh Schedule).

  1. The Federal List had 59 items, such as defence, external affairs, currency, railways and posts. Only the Federal Legislature could make laws on them.
  2. The Provincial List had 54 items, such as police, education, public health, agriculture and land revenue. Only the provincial legislatures could make laws on them.
  3. The Concurrent List had 36 items, such as criminal law, civil procedure, marriage and contracts. Both could make laws on them. Where the two laws conflicted, the federal law prevailed (section 107).
  4. Residuary powers. A subject in none of the Lists could be assigned by the Governor-General, in his discretion, to the Federal or a provincial legislature (section 104).

Why it mattered. For the first time the Centre and the provinces each received a field of law-making of their own, guaranteed by statute. This made provincial autonomy possible: from 1 April 1937 each province was governed by ministers responsible to its own legislature, and dyarchy ended. The Act also planned an All-India Federation of provinces and princely States, which never came into being.

The three Lists passed into the Constitution of India. Its Seventh Schedule still divides powers into a Union List, a State List and a Concurrent List.
