In one line

Who grants coastal clearance depends on which category the project is in, and the answer changed in 2019.

In the wording a student can write in an examination: paragraph 7 of the Coastal Regulation Zone Notification 2019 provides that all permitted or regulated project activities attracting the provisions of the notification shall obtain CRZ clearance prior to their commencement, that all development activities or projects in CRZ-I and CRZ-IV areas shall be dealt with by the Ministry of Environment, Forest and Climate Change based on the recommendation of the concerned Coastal Zone Management Authority, that for all other permissible and regulated activities falling purely in CRZ-II and CRZ-III areas the clearance shall be considered by the concerned Coastal Zone Management Authority, that a project in CRZ-II or III which also traverses CRZ-I or CRZ-IV shall go to the Ministry, that a project attracting both this notification and the Environmental Impact Assessment Notification 2006 shall be dealt with for a composite environmental and CRZ clearance under the notification of 2006, that a building project below the threshold of that notification shall be approved by the local planning authority after obtaining the recommendations of the Coastal Zone Management Authority, and that a self-dwelling unit up to a total built up area of three hundred square metres shall be approved by the local authority without any such recommendation.

The delegation, which is the substantive change

Before 2019 almost everything went to Delhi. The notification of 2019 decentralised, and the scheme is a graded one.

Three observations.

The most sensitive categories stayed central. CRZ-I, the ecologically sensitive areas and the intertidal zone, and CRZ-IV, the water area, are still decided by the Ministry.

A project that touches a sensitive category goes central. A pipeline crossing the intertidal zone to a plot in CRZ-II is a Ministry matter, however small the landward part.

The householder was released. A self-dwelling unit up to three hundred square metres needs no recommendation from the coastal authority at all, though the local authority must still examine the proposal from the perspective of the notification. That single line removed a very large number of applications from the system.
