In one line

Three sections that let a regulator close a factory and cut off its electricity without going to any court, and they are the sanction a polluter actually fears.

In exam wording: section 5 of the Environment (Protection) Act 1986, section 33A of the Water Act 1974 and section 31A of the Air Act 1981 empower the Central Government or a State Board, notwithstanding anything contained in any other law, to issue directions in writing to any person, officer or authority, who shall be bound to comply, and such directions include the closure, prohibition or regulation of any industry, operation or process and the stopping or regulation of the supply of electricity, water or any other service.

The three sections, which are the same section three times

Section 5 of the Environment (Protection) Act. The Central Government may, in the exercise of its powers and performance of its functions under the Act, issue directions in writing to any person, officer or any authority, and such person, officer or authority shall be bound to comply with them.

The Explanation is where the power lives: the power to issue directions includes the power to direct

(a) the closure, prohibition or regulation of any industry, operation or process; or (b) the stoppage or regulation of the supply of electricity or water or any other service.

Section 33A of the Water Act and section 31A of the Air Act give the same power to a State Board, in the same words, and both open "notwithstanding anything contained in any other law but subject to the provisions of this Act and to such directions as the Central Government may give".

Learn the three together and learn the Explanation verbatim if you learn nothing else in this chapter. Closure, prohibition, regulation. Electricity, water, any other service.Those seven words are the whole of Indian environmental enforcement in practice.

Why this is the sanction that matters

Speed. A direction is an order in writing. It requires no complaint, no adjudicating officer, no magistrate and no trial. A Board that samples an effluent on Monday can direct closure on Friday.

Reach. "Any person, officer or any authority" includes a Government department, a local body and a State electricity distribution company. That last is what makes the utilities limb work: the direction to cut supply is addressed not to the polluter but to the supplier, who is bound to comply.

Effect. A penalty is a debt and can be provided for. A closure stops production, and a factory that cannot run cannot pay its workers, service its loans or supply its customers.

Put the comparison plainly. A prosecution under the old section 43 took years and ended in a fine of a few thousand rupees. A penalty under the new section 43 takes months and costs up to fifteen lakh with a daily addition. A direction under section 33A takes daysand costs the business. Ask any factory manager which of the three keeps them awake.
